Chris's Qualifications—Who is Chris McFadden?


He is an experienced appellate lawyer. McFadden has practiced primarily before the Court of Appeals of Georgia and the Supreme Court of Georgia for twenty years. He has handled a wide variety of civil, criminal, and domestic appeals. Over eighty of his cases have resulted in published opinions, most by the Court of Appeals of Georgia. He has made dozens of oral arguments, most to the Court of Appeals of Georgia. He is a founder and past chair of the Appellate Practice Section of the State Bar of Georgia.


He wrote the book on Georgia appeals. McFadden, Brewer, & Sheppard's Georgia Appellate Practice (West), first published in 1996 and now published in annual editions, is the leading reference book on Georgia appeals.


He is committed to justice. Working with the Georgia Innocence Project, McFadden helped secure the DNA exoneration of Robert Clark. McFadden described that case, as well as lessons to be drawn from it and from similar cases, in an op-ed, The Exoneration of Robert Clark. Working with a committee of the state bar McFadden drafted a proposed amendment to Georgia's Appellate Practice Act, which was enacted exactly as he drafted it. Each year, because of that amendment, people whose appeals once would have been thrown out because of a procedural error get heard.


He is a defender of the ideal of a fair and impartial judiciary. He spoke out in defense of those ideals in an op-ed entitled Truth, Justice, All That Stuff. He spoke out in defense of nonpartisan judicial elections in an op-ed entitled Partisan Election Counters Rule of Law. Until the announcement of his candidacy, McFadden was a member of the executive committee of the Georgia Committee for Ethical Judicial Campaigns. Presently an officer of the Atlanta Bar Association, he successfully advocated that organization's adoption of a policy of speaking out in support of judges who have been inappropriately criticized for unpopular decisions. He helped found and served on the Atlanta Bar's Judicial Campaign Conduct Committee.


He will be able to hit the ground running. McFadden has the knowledge and experience to contribute from his first day as a judge on the Court of Appeals. Voters all across Georgia—from the mountains to the coast, and from North Georgia to Middle Georgia to South Georgia—can have the satisfaction of marking their ballots for Christopher McFadden in the nonpartisan Court of Appeals election on November 2, 2010. McFadden is the right person for the job.
